Debit Card Terms & Conditions

Dhanlaxmi Bank Ltd. International Debit Card is brought to you in association with VISA International. It is accepted across the world at all ATMs and Merchant Establishments (MEs), where the VISA Logo is displayed and also has the facilities to withdraw cash and make balance enquiries through our own ATMS and the ATMs of member banks of shared ATM networks -  Cashtree, Cashnet and Infinet. This card gives you the freedom to make purchases without the hassles of paying cash. You don’t need to carry cash, nor pay bills at the end of the month…your purchases will be debited to your account instantly.

ATM-Cum-Debit card gives you access to your account whenever you want, wherever you want.

The use of our ATM-cum-Debit card is governed by Terms & conditions stipulated hereunder.

The following are Terms & Conditions for issue and use of the Visa International Debit Card.


I. Meanings of TERMS

1.   Bank refers to “Dhanlaxmi Bank Ltd.”.

2.  “ ATM Branch” refers to the branch of the bank where an ATM is attached and
               where the cardholder maintains the primary account.

3.  “Non-ATM Branch” refers to branch of the bank without an ATM installed but connected to the ATM network.

4.  “ATM” means any Automated Teller Machine in India or abroad whether owned by Dhanlaxmi Bank Ltd. or any other bank on a shared network at which, amongst other
     things, the customer can use the Visa International ATM-Cum-Debit card to access the account of the cardholder held with Dhanlaxmi Bank Ltd.


6.  Cardholder means “the person who has been issued Dhanlaxmi Bank Ltd.’s ATM CARD or Dhanlaxmi Bank Ltd.’s VISA INTERNATIONAL ATM-CUM-DEBIT CARD to operate his/her/their a/c through ATM.”

7.  Primary Account means “there may be multiple accounts in which one account shall be designated as the “Primary account” at the option of the cardholder to which all the  amounts  authorized/dues payable by the cardholder are debited.”

8.  Secondary Account means “Term Deposit/other accounts of the ATM account holder with the bank and branch”.

9.   ATM Account means “the Primary Account”.

10. Merchant Establishments (MEs): Merchant Establishments shall include shops, stores,
     restaurants, hotels and commercial establishments etc. advertised as handling the ATM-Cum-Debit cards by displaying the VISA logo.

11. POS Terminals: Point of Sale (POS) Electronic terminal at a Merchant Establishments in   India or abroad at which the customer can use his/her DEBIT card through the PIN/Signature verification to make purchases by debiting his/her account online with the bank.

12. “PIN” means Personal Identification Number allocated to the customer by the bank or chosen by the cardholder from time to time, which is required to access ATMs in India or abroad.

13. “International Transaction” means any transaction carried out by the cardholder in any center other than in India, Nepal and Bhutan.

14. “VISA ATM Network” means ATMs that honor the Debit Cards or Credit Cards and that display the VISA, Plus or Electron symbols.

15. “The Issuer” in relation to cardholder means the Bank.


II. Applicability of Rules and regulations

1. The issue and use of card shall be subject to the terms and conditions of Dhanlaxmi Bank Ltd. ATM-Cum-Debit card and the rules and regulations in force from time to time as issued by the Reserve Bank of India, Dhanlaxmi Bank Ltd., FEMA, 1999 and Visa International.

2. Utilisation of the ATM-Cum-Debit card shall be strictly in accordance with the FEMA, 1999 and any other law and/or regulation in force from time to time. In the event of failure to comply with the said rules, the cardholder is solely liable for action under the FEMA, 1999 and may be debarred from holding the ATM-Cum-Debit card from Dhanlaxmi Bank Ltd. at the instance of the Bank or RBI or any other regulatory authority.


III. Cardholder’s obligations:

1. Validity & Expiry period

ATM Cards: In case the customer holds existing ATM Cards, such cards shall be withdrawn on the expiry date and Dhanam Debit Cards will only be in force.

Debit cards: VISA enabled Debit Cards are issued and are valid for a period of five years. Debit cards can be used at all Visa enabled ATMs in addition to the ATMs of The Dhanalakshmi Bank and member banks of shared ATM Networks of Cashtree, Cashnet and Infinet. This can also be used to carry out Point of Sale transactions at various Merchant Establishments where the Visa logo is displayed. The details are available elsewhere in this booklet.


2. Ownership of the Card

The Card is not transferable. Card shall be the property of the bank and is to be surrendered to the bank on request or in the event that the cardholder no longer requires the service. The bank reserves the right to disclose, in strict confidence, to other institutions, such information concerning the cardholder’s account as may be necessary or appropriate in connection with its participation in any ATM or Electronic Fund Transfer Network

*The charges, if any, shall be debited online or as and when intimated by other banks (transactions through other Bank ATMs) to the cardholder’s primary account for which the cardholder should maintain a sufficient balance. The bank has the absolute discretion to amend or supplement the above charges from time to time and these charges shall be notified on the notice board. Cardholders shall be bound by such changes.

2. Point of Sales (POS) at Merchant Establishments (MEs): The Debit cardholder can use  it to make purchases from the shops/establishments (refer definition part) and there will be no charges for using this facility except at Petrol pumps and Railway stations where charges will be applicable as per industrial practice.

 4. Card Issue Charges

At present no charges will be levied for issue of fresh ATM cum Debit cards. The bank has the absolute discretion to amend or supplement the above charges from time to time and these charges shall be notified on the notice board. Cardholders shall be bound by such changes.

 5. Add on Cards

Add on Cards or Additional cards (maximum 3 cards) will be issued to the Primary account holder (Either or Survivor accounts) for the primary account on getting a written request specifying the details. This card can be used for transactions in the same account but with a separate card number and PIN. A handling charge of Rs.100/- per card will be charged for Add on cards.

 6. Initial Deposit

The initial deposit for issuing an ATM card will be the minimum amount required to open any primary account. This amount can be changed from time to time at the discretion of the bank without intimating the cardholder.

 7. Minimum Balance Requirement, Service Charge.

The cardholder shall maintain, at all times, such minimum balance in his/her primary account, as the bank may decide from time to time, notified on the notice board and the bank may, at its discretion, levy such penal or service charges or other charges as per the bank’s rules from time to time. ATM accounts can be operated with the stipulated minimum balance. Service charges for non-maintenance of the minimum balance will be applicable as per rules. The bank has the absolute right to withdraw or suspend the ATM facility, if at any time the deposit amount falls short of the required minimum or otherwise, for any reason, without giving any further notice to the cardholder and / or without incurring any liability or responsibility whatsoever be the reason of such withdrawal or suspension. Service charges or any other charges leviable that may be decided by the bank from time to time and notified on the Notice Board shall be debited to the cardholder’s account from time to time and the cardholder is unconditionally liable to pay/provide funds for such levies. In the event that the ATM account (s) is overdrawn the cardholder shall be liable to pay interest at such rates as may be fixed from time to time, by the bank.

 8. Withdrawals

The withdrawal of cash by the cardholder from his/her/their ATM account shall be online and the maximum limit, up to a sum of Rs.1,00,000 per day/card depending upon the type of account the customer holds or such other amount fixed by the bank from time to time, and withdrawal shall be allowed during the cycle of 24 hours commencing from 12.00 midnight every day, subject to the ceiling regarding number of transactions per day, which at present, is 10. A maximum limit of Rs.1,00,000 is also fixed for POS transactions per day/card depending upon the type of account the customer holds

 9. Deposit

Two members of the bank’s staff, wherever such facilities are provided, shall verify the amount of cash/cheque deposits, one of whom will be an officer. The amount verified and recorded by the bank shall be deemed to be the correct amount deposited by the cardholder. The ATM does not count cash and the temporary receipt issued by the ATM, on the basis of the information keyed in by the cardholder, is not binding on the bank. The statement issued by the ATM at the time of deposit only represents what the cardholder purports to have deposited in terms of the data and the details keyed in by him while making such deposit and will not be binding on the bank. If there are soiled/mutilated notes in such deposits the acceptance of such deposits shall be subject to final acceptance and reimbursement by RBI as per the Note Refund Rules.

Deposit of cash shall be made in the denomination of currency notes, as stipulated by the bank, from time to time. Deposits of cash will be made available to the cardholder only when the amount is credited to the primary account of the cardholder on the next working day and not when the deposit is made. Cheques will be accepted for collection only and the proceeds will not be available until they have been collected and credited to the primary account. Cash/Cheques deposited in the accounts in other centres of the cardholder will be accepted only when the networking operations are available and the terms and conditions would be governed accordingly. Till the networking is completed and made online cash/cheque should be deposited only at ATMs attached to the base branch. Deposits of foreign currency cash/cheques or any other deposits, which are unacceptable, shall be returned, at the cardholders cost, risk and responsibility. The cardholder shall be liable to reimburse the wrong credits if any, occurred in his/her/their accounts. Separate covers provided at the ATM Point should only be used to deposit cash/cheque.

 10. Dishonoring the Card

If the card is not honoured in the desired manner for any reason whatsoever, or if the ATM is destroyed or not functioning due to Force Meajure or due to power failure, temporary insufficiency of cash in the ATM or for any other reason the bank shall in no circumstances be held liable to the cardholder for consequential or indirect loss or damage arising therefrom.

 11. Stop Payment

Wherever cards are issued to more than one accountholder, in case any of the account holders give stop payment / stop transaction instructions, in respect of the operation through the use of the ATM/Debit Card of the ATM account held jointly by them, no operations will be allowed on such ATM accounts in which he / she is a joint account holder. However, the bank shall not be held responsible for any drawings affected during the interval from the receipt of stop payment instructions until it is recorded in the ATM/computer. The branch is also free to stop operations in the primary account on receipt of garnishee or legal orders attaching or otherwise prohibiting or restraining the bank or branch in dealing with the money of the cardholder in the custody of the branch/bank.

 12. Closure of ATM Account

If the cardholder desires to close the account / surrender the card, he may give the bank not less than 10 days notice in writing and may surrender the card. The cardholder shall also pay dues if any payable to the bank, in connection with the ATM facility, before requesting closure of the facility. If such closure is requested within six months from the date of opening, a service charge of Rs. 100 shall be recovered.

 13. Bank’s lien
The bank shall have the right of set off and lien on the deposit held in the cardholder’s primary account and / or in the secondary account (s) or in any other account, whether in single name or joint name(s), to the extent of all outstanding dues, whatsoever arising as a result of the ATM/Debit card services extended to and / or used by the cardholder.

14. Responsibility for transactions processed through ATMs

The cardholder is solely responsible for all the consequences arising out of the disclosures of his / her PIN and / or unauthorized use of his / her card and shall be liable for any increased liability which he / she may incur on account of unauthorized use of the PIN and the card. The cardholder shall in all circumstances accept full responsibility for all transactions procured by the use of the card whether or not procured with cardholders knowledge or authority expressed or implied. The printed output that is produced at the time of operation is a record of the operation of the ATMs and shall not be construed as the bank’s records. Only the bank’s records of transactions shall be accepted as conclusive and binding for all purposes.


15. ATM Account

The ATM/DEBIT CARD shall be issued to an approved customer in respect of his/her/their satisfactorily maintained accounts such as Savings Bank, Current Deposit, Dhanam Plus, Dhanam Double Plus, Dhanam Savings Loan, Staff Overdraft accounts or any other accounts at the sole discretion of the bank, which shall be called the Primary Account. The card will be sent directly through M/s.Fidelity Information Services Payment Solutions & Services Pvt. Ltd. with whom the bank has signed an end-to-end outsourcing contract. The PIN mailer has to be send by normal post at the customer communication address. Issue of the ATM/Debit Card against an overdraft/cash credit account shall be subject to credit norms fixed by the bank and the terms of sanction of the limits. (Such account(s) shall be referred to as ATM accounts.) The cardholder shall give his/her preference of such account(s) held by him/her in writing in the application form for issue of ATM/DEBIT Card. Only individual account holders and sole proprietorship concerns are eligible for the facility.

NRI: Holders of NRE savings and current accounts are also eligible for ATM/Debit card.

A minor or an account in which a minor is a joint account holder (joint operation) is not eligible for a ATM/Debit Card.

Joint accounts, with joint operations, are not eligible for a ATM/Debit Card since operations are restricted to account holders with joint signatures.

ATM Card/Debit Card will not be issued to other entities like partnership firms, companies, trusts, societies etc.

16. Linking of other eligible accounts

Other eligible accounts of the account holder, in ATM Branch or NON ATM Branch (es), will be linked to the ATM/Debit cards by written request of the primary cardholder and on request and confirmation from the branches where the accounts exist. Linking of accounts shall be as per the facilities available and will be made available to the extent possible and is at the sole discretion of the bank.

17. ATM Facilities

a) Cash Withdrawal/Fast cash: Subject to the availability of sufficient balance / within the overdrawing limit sanctioned in the ATM Account, the cardholder can operate the ATM account to withdraw funds within the limit fixed for drawing/number of transactions per day.

b) Balance Enquiry: Enquire about the balance outstanding in the ATM account.

c) Mini Statement: Requisition for a statement with a limited (latest) number of transactions of the ATM account when online.

d) Fund Transfer: Request for transfer of amount from the primary account to the secondary account, to the extent of the availability of the service.

e ) Deposit of cash/cheques: Deposit of cash/cheques for credit of the Primary ATM Account (available “only” in select ATMs).

The Bank reserves the right to withdraw any or all of the facilities above without prior notice and without assigning any reason thereof or add any such facilities as the bank may decide to provide from time to time.


18. Personal Identification Number

  • The ATM-Cum-Debit card is operational with the help of a confidential Personal Identification Number (PIN) at all ATM locations worldwide.
  • The Cardholder shall receive by courier/post/collect a PIN number in a sealed envelope at their communication address for operation of the ATM/POS by using the card. In case the PIN mailer is received in a mutilated or damaged condition, the cardholder should return the same immediately to the bank for issue of new PIN.
  • Each cardholder shall be provided with a secret PIN through the pin mailer.
  • The cardholder shall change the secret PIN issued through the pin mailer immediately after activating the ATM-CUM-DEBIT Card. The cardholder shall select his/her own PIN to gain access to the ATM facilities.
  • The cardholder shall not record the PIN or code, in any form that would be intelligible or otherwise accessible to any third party if access is gained to such a record either honestly or dishonestly.
  • The bank bears no liability for the unauthorized use of the ATM-CUM-DEBIT card.
  • The cardholder shall be solely responsible for the consequences arising out of the disclosure of PIN and / or unauthorized use of the card and shall be liable for any increased liability, which may be caused or resulted on account of such unauthorized use of the PIN and the card.
  • If customer uses an incorrect PIN many times in succession and due to some other errors, the card may be captured in some of the machines and shall be collected from the concerned issuer branch/bank.


19. Usage of Debit cards at POS:

  • The bank is not responsible for the refusal by any ME to accept or honour the card nor shall it be responsible, in any manner, for the goods or services supplied to the cardholder. The cardholder shall handle or resolve all claims or disputes directly with such Establishment and no claim by the cardholder against the ME is subject to set-off or counterclaim against the bank. The bank will credit the cardholder’s account with the amount of refund only upon receipt of a properly issued credit slip or cheque or draft.
  • The bank will not be responsible for furnishing original bills of the ME to the cardholder.
  • The cardholder will collect from the ME the cardholder’s copy of the transactions slips/receipt and preserve the same for his personal record. However, at its discretion and upon the request of the customer, the bank may provide copies thereof if the request is received in writing within 15 days from the date of the transaction, subject to an additional fee, which is subject to change at the discretion of the bank.
  • The bank, at its discretion, will approve/reject any card transaction.
  • The cardholder cannot countermand an order which has been given by means of his/her card.
  • The bank shall not be liable for any loss caused by a technical breakdown of the payment system.
  • No cash transaction, that is, cash withdrawals or deposits should be offered at the point of sale, with the debit cards under any facility, without prior authorisation of RBI under section 23 of the Banking Regulation Act, 1949.
  • Debit cards cannot be used on Internet for purchase of prohibited items like lottery tickets banned or prescribed magazines etc.
  • The cardholder shall sign on the charge slip/transaction slip authenticating the transactions through the debit card.
  • Any charge slip not signed by the cardholder, but can be proven to have been authorized by the cardholder will be deemed to be cardholder’s liability.
  • The bank shall not be responsible for the quality of the product/service.
  • The bank accepts no responsibility for any charges over and above the value/cost of transactions levied by any ME and debited to cardholder’s account. The cardholder should ascertain such charges before availing the services through the ME.
  • A purchase and subsequent cancellation (including purchase and cancellation airline/railway tickets, etc) are two separate transactions. Such refunds shall be credited to the cardholder’s account subsequently after due verification and as per VISA rules and regulations. The cardholder agrees that any debits received during the time of transactions will be honoured based only on the available balance in the account, without considering the pending refund. The cardholders also indemnify the bank from acts of dishonouring the payment instructions in such circumstances. If the amount is not credited within 30 days of such cancellation, the cardholder should notify the bank along with a copy of the credit slip issued by the ME.
  • For payments at MEs only the primary account of the cardholder will be debited. In case of
    insufficient funds in this account, such transactions would be declined, even though there might be sufficient balance in other accounts cumulatively/severally.
  • The cardholder shall refrain from using the Debit card for hotel check-in as also at such locations where paying arrangements are done before completion of purchase transactions/services.
  • Should the cardholder choose to disagree with an amount debited to his account, the same should be communicated to the bank within 15 days of the transaction date, failing which it would be construed that all charges are in order.
  • Any Government charges, duty or debits, or tax payable as a result of the use of the card shall be borne by the cardholders and if imposed, upon the bank (directly or indirectly), the bank shall debit such charges, duty or tax to the cardholder’s a/c.
  • The cardholders alone shall make use of the card and shall not allow any other person to use the same on his/her/its behalf. The card shall not be transferable.


20. Loss/Theft/Copying of ATM-Cum-Debit cards

  • The card should remain in cardholder’s possession and should not be handed over to anyone else. In the case of loss / theft of the card, the cardholder shall immediately report in writing about such loss/theft to nearest bank branch with instructions to hot-list/freeze and cancel the facility of ATM card in the Primary Account or call to the customer contact centre at +91 0487 6613000.
  • The cardholder will be responsible and liable for all transactions effected by the use of the card until the information about the loss/theft of the card is reported to the branch and the ATM card is hotlisted/frozen and cancelled by the branch.
  • Bank is fully indemnified against any liability (civil or criminal), loss, cost, expenses or damages that may arise due to loss or misuse of the ATM-Cum-Debit card in the event that it is lost and not reported to DLB or lost and misused before DLB is notified.
  • The branch will issue a new ATM–Cum-Debit card after proper verification, at its sole discretion and upon receipt of written request along with a copy of the FIR lodged with the police authorities.
  • A prescribed fees of Rs.100 shall be charged for such issue of another ATM-Cum-Debit card.
  • If cardholder subsequently recovers the lost ATM-Cum-Debit card, it should not be used and the card should be destroyed by cutting it into several pieces across the magnetic strip.

 21. Hot listing/Termination of ATM CARD facility

In case the bank decides to hot-list an ATM/DEBIT CARD or cancel the ATM facility for any reason
whatsoever, the ATM-Cum-DEBIT CARD facility shall stand automatically cancelled/withdrawn. The bank will not be in a position to intimate the cardholder personally before hot-listing such ATM card. The bank shall be entitled to terminate the ATM/DEBIT card facility with immediate effect and recall/return of the ATM/DEBIT Card upon the occurrence of any of the following events:

  • Failure to adhere or comply with these terms and conditions or as may be stipulated from time to time.

Upon hot listing the ATM/DEBIT CARD or in the event of default under any agreement or commitment (contingent or otherwise) entered into with the bank.

Upon the bankruptcy or any insolvency/other proceedings of similar nature on the cardholder.

  • Death of the cardholder.

22. Free Insurance cover (arrangement with insurance company)

The Insurance benefit, if any, provided on the card will be available as per the terms of insurance policy in force, as long as the cardholder remains a cardholder of DLB with the conduct of the account being deemed satisfactory and in the event of the card and or account being terminated for whatever reason, the benefit of such insurance cover shall automatically and ipso facto cease to be available from the date of cessation of membership.

23. Disputes:

1. In case of purchase transactions, a sale slip with the signature of the cardholder and the card number, noted thereon, shall be conclusive evidence between the bank and the cardholder as to the extent of the liability incurred by the cardholder and the bank shall not be required to ensure that the cardholder has received the goods purchased/availed of the services to the cardholder’s satisfaction.

2. The suits and proceedings against the issuer relating to any claims, disputes or differences arising out of or in respect of the card, shall be instituted only in the court situated at Thrissur and no court situated in any other place shall have jurisdiction to entertain or decide such matters. The issuer may, however, at its option institute any such suits or proceedings against the cardholder at any place where the cardholder resides or carries on business for work or gains or maintains his account with any branch of the issuer or in the place where the Head Office of the issuer is situated.

3. The bank does not accept any responsibility for the refusal of any MEs to honour the card.

4. The cardholder will be responsible for all the costs associated with the resolution of the dispute.

24. Exclusion of the liability:

Without prejudice to the foregoing, the bank shall be under no liability whatsoever to the cardholder in
respect of any loss or damage arising directly or indirectly out of:

  • Any defects in goods supplied or services rendered by any MEs.
  • The refusal of any MEs to accept the ATM-Cum-Debit card.
  • Any malfunction/non-function of any device/communication channels or any other equipment directly responsible for enabling transactions in the ATM-Cum-Debit card.
  • Effecting transaction instructions other than by the cardholder.

Parting with the card to any unauthorised persons, including employees of the bank, not designated to receive the card.

  • Exercise of the bank of its right to terminate any card.

The exercise of the bank’s right to demand and procure the surrender of the card prior to the expiry date exposed on its face, whether such demand and surrender made and/or procured by the bank or by any person or computer terminal.

  • Decline of a charge because of excess foreign exchange entitlements as prescribed by RBI from time to time or the bank becoming aware of the cardholder exceeding his/her entitlement.

Any mis-statement, mis-representation, error or omission in any details disclosed by the bank.

  • Any injury to the character and reputation of the cardholder, alleged to have been caused by the re-possession of the card and/or any request for its return or the refusal of any MEs to honour or accept the card.
  • The Bank accepts no responsibility and will not be liable for any loss or damage for any service failures or disruptions (including but not limited to loss of data) attributable to systems or equipment failure or due to reliance by the bank on third party products or interdependencies, including but not limited to electricity or telecommunications.

The bank accepts no liability or responsibility for the consequences arising out of the interruption of its business by acts of God, riots, civil commotions, insurrections, wars or any other causes beyond its control, or by any strikes or lockouts.

  • Subject to the foregoing provisions, the cardholder will not hold the bank liable in case of

improper/fraudulent/unauthorised /duplicate/erroneous use of the card and/or PIN if the card lands in the hands of any third party or if the PIN becomes known to any third party.

In the event of any misuse, the bank reserves the right to seize/capture/hot-list the card or withdraws the ATM/card facility without any notice to the cardholder.


25. Other conditions

The card service is meant for withdrawals against the balance already available in the designated account. It is the cardholder’s obligation to maintain sufficient balance in the designated account to meet withdrawals and service charges.

If the ATM is not running online, the transactions in the ATM will be accounted for on the same/next working day.

On becoming aware of the recording on the cardholders account of any unauthorized transactions or of any error or other irregularity in maintaining that account by the bank, the cardholder shall immediately notify the same to the issuing branch of the bank. The cardholder is under an obligation not to countermand an order, which he has given by means of ATM-cum-Debit Card.

The bank may, at its discretion, refuse any application for ATM-Cum-Debit cards without assigning any
reason. Fees for the use of the card are not refundable under any circumstances.

The bank reserves the right to add to, delete from these terms and conditions as it thinks fit in
itsabsolute discretion and without assigning any reason whatsoever and such changes shall be binding on the cardholder.

The cardholder shall undertake to furnish to the bank, the changes, if any, in respect of any information furnished in the application form within 7 days from the date of occurrence of such changes. The bank may take cognizance on such changes only after the expiry of 30 days from the date the information is received by it.

The cardholder shall be deemed to have unconditionally agreed to and accepted these terms and conditions by either signing the card application form or acknowledging the receipt of the card in writing or by signing the reverse of the card or by performing a transaction with the card.


26. Disclosure information

  • The cardholder hereby expressly authorizes the bank to disclose, at any time and for any purposes, any information whatsoever relating to his/her particulars, accounts, transactions or dealings with the bank, to any court of competent jurisdiction, quasi judicial authorities, law enforcement agencies, Govt. or regulatory agencies like RBI etc, or authorities in India or elsewhere, any agents or contractors which have entered into an agreement to perform any service(s) for the bank’s benefit and any other person(s) whatsoever where the disclosure is required by law or otherwise to whom the bank deems fit to make such disclosure.

The cardholder agrees to provide the bank information that the bank requires from the cardholder by law or regulation or any other appropriate information that the bank may reasonably require from time to time.

  • The cardholder agrees to the bank providing any part or full information about his/her dealings with the bank through the card or otherwise to RBI or such other regulatory agency (ies) under any statutory or regulatory provisions such as FEMA, 1999, etc.

The bank reserves the right to utilize the information and data generated through the usage of the card by the cardholder in any manner whatsoever deemed fit in the conduct of its business.

27. Indemnity

a)    In consideration of the bank providing the cardholder with the debit card facility, the cardholder hereby agrees to indemnify and keep the bank indemnified from and against all actions, claims, demands, proceedings, losses, damages, personal injury, cost charges and expenses whatsoever which the bank may at any time incur, sustain, suffer or be put to as a consequence of or by reason of or arising out of the bank’s acting in good faith and taking or refusing to take or omitting to take action on the cardholder’s instructions, and in particular arising directly or indirectly out of the negligence, mistake or misconduct of the cardholder, breach or non compliance of the rules, terms and conditions relating to the card and the account and/or fraud or dishonesty relating to any transaction by the cardholder or his/her employee/s or agent/s.

b)    The cardholder agrees to indemnify the bank against all liabilities, losses, damages and expenses which the bank may sustain or incur either directly or indirectly as a result of:-

i.    Negligence, mistake or misconduct of the cardholder
ii.   Breach or non-compliance to the rules/terms and conditions relating to the card and the account.
iii. Fraud or dishonesty relating to any transaction by the cardholder or his employees/agents etc.
